Violent assaults on children in several highly publicized incidents have spurred states to pass new laws cracking down on sex offenders. A majority of states now notify residents of communities where a sex offender has been released. Some detain especially dangerous sex criminals for an indefinite term of mental treatment once their sentences expire. These laws are being challenged in the courts by those who charge they punish individuals for the same crime twice.

Before turning to discuss the subject of this chapter—punishment of sex offenders—it is important to discuss the general characteristics of punishment as a whole. Antony Flew holds that punishment must contain at least five elements that distinguish this term from other hardships people may suffer from. First, the person who is punished must consider it a hardship or unpleasantness; this means that a punishment cannot be something beneficial to the punished person I will argue later in this chapter that the rehabilitation of offenders cannot be considered punishments. Second, it should be a reaction to an offense, meaning that people should not be arbitrarily punished for no reason. Third, it should be inflicted only on the guilty offender and not imposed on innocent victims or suspects whose guilt has not been proven. This is a very important component, since it prohibits us from arbitrarily punishing persons who did not commit a crime or an offense.
The popular version has it that in spring 1349 a mob attacked the Jews in Erfurt and killed all or at least most of them. However, the newly built second synagogue was depicted in a handwritten chronicle and was used by the Jewish community of Erfurt until their expulsion from the city in 1458. Some twenty years later, the building was converted into a church. After the conflagration of 1736 the remnants of the church were pulled down, so that there is no leftover from the second synagogue. Another version says that the Jews resisted the attackers so that they set the Jewish houses on fire.
